Inspection Agreement

Visible Inspection Agreement
DiRaddo’s Home Inspection Services, LLC
(please read carefully)

This Inspection Contract is between______________________________________
hereafter referred to as “client(s) and (DiRaddo’s Home Inspection Services LLC) hereafter referred to as “the company”.

This inspection has been/or will be performed in accordance with the American Society of Home Inspectors, Inc.(ASHI) Standards of Practice except as otherwise specifically noted in the comments section of this report. Inspector will conduct a visual inspection of the property only.

Right Of Entry:  I warrant that I or my agent have made all necessary arrangements with the selling party for the inspection company to enter and inspect the property described in this agreement.

Severability:  If any portion of this contract is deemed unenforceable, the remainder of the contact shall be treated as though the unenforceable portion did not exist.

Participation:  I have been encouraged to participate in the inspection and accept responsibility for incomplete information should I not participate in the inspection. My participation shall be at my own risk for falls, injuries, property damages, etc.

Scope Of The Work:  The intent of the standard visual inspection work is to look for “exposed to view” things which need major repair or further evaluation by a specialist. It is limited to the readily accessible and visible major systems ( electrical, plumbing, etc) components and equipment of the primary home on the property. Weather limitations affecting the extent of the work are accepted without additional burden to the inspector or inspection company. Inspector is not responsible nor liable for the non-discovery of any patent or latent defects in materials, workmanship or other conditions of the property which may occur or become evident after the inspection time and date.

I accept that certain things will be randomly sampled, that hidden damages and conditions, public records, codes, engineering, pest, and environmental checks are beyond the scope of the standard visual inspection.

Risk Assessment:  I understand this work cannot accurately and completely assess risk, detect all flaws, predict all occurrences, or make assurances. I accept this will not eliminate my risk and I will not burden the inspector or inspection company with such risk. I understand this is no warranty, guarantee, or insurance policy though some jurisdictions may imply such. I will purchase such instruments from others if I desire.

Pre-Settlement:  I accept that this work is no substitute for a pre-settlement inspection for which I am responsible since damages, mechanical failures, and symptoms, clues, etc. may appear after this work and before my legal acceptance of the property. I waive all claims against the inspector or inspection company in the absence of diligently performing my pre-settlement inspection and for lack of more extensive investigation and follow through with a specialist on any problems noted including confirmation of any cost approximation.

Third Party Liability:  I request this inspection and report, for my confidential use only. I promise to indemnify and hold harmless the inspector and inspection company for any damages and/or expenses involved in addressing or defending claims made by others in attribution of this report.

Legal Fees/Other Expenses:  If I make a claim against the company for any error, omission or other act arising out of this work and fail to prove such claim, I will pay all attorney/solicitor fees, arbitrator fees, expenses and costs incurred in the defense of the claim. I will reimburse for all expenses associated with returned checks or denied credit card charges.

Exclusions:  The inspector does not include and will not address the presence of or danger from asbestos, mold, radon gas, lead paint, lead in water, formaldehyde, pesticides toxic or flammable chemicals, water or airborne related illness or disease, and all other similar or potentially harmful substances or conditions are excluded. No water, air soil, or material analysis of any kind, including those for health or environmental consideration will be performed, unless any of the following test(s); radon, well, sewer lines, septic systems, lead, mold are specifically requested by the client signing the company’s agreement form for each test requested, and the client paying the fee set by the company with respective limitations.

Also excluded are electrical lines and circuits, underground or concealed pipes, cable TV cables, central vacuum systems, central air conditioning when outside temperature is below 65, swimming pools, retractable roofs, security systems, water softeners, water purification systems, hot tubs, saunas, and all related wiring and equipment, above and underground storage tanks of any kind, sprinkler systems and the confirmed presence or absence of or damage done by rodents, wood borers and other insects animals and the like. Barns, playsets, treehouses, sheds,and/or other out buildings are also excluded. In the event that a specific condition or substance is identified, it is intended to raise the clients’s awareness about that item in particular indicating that a more comprehensive analysis is needed by a qualified expert in that specific field which is not part of this inspection or services provided hereby.

The Company’s Liability, including that of the inspector(s) if he/she has any, for any loss or damages claimed or suffered by the client(s) which is related to or arises out of the inspection or other services provided to the client(s) at any time, is limited to the amount paid for the inspection and/or other services. Client(s) also agree that no action to recover damages can be brought more than one year after the date of this inspection or other services, time being of the essence.

Disclosure:  The information in this report is the property of the client solely for this transaction. It may be disclosed by the inspection company to real estate agents, sellers, lenders or other parties intimate to this particular transaction for the purpose of clarification and facilitation of repairs with the client’s permission.
